RunPact — Terms and Conditions

These Terms govern your use of therunpact.com and any services we offer through it (together, the "Service"). The Service is operated by Done By Nine Limited (NZBN: 9429048445962, company number 8053123, registered office: 93 Devon Street West, New Plymouth 4310, New Zealand) — referred to in these Terms as "RunPact", "we", "us" and "our".
By using the Service, taking the quiz, submitting your email, or buying a Race Pack, you agree to these Terms. If you don't agree, please don't use the Service.
These Terms should be read alongside our Privacy Policy, which forms part of your agreement with us.
1. Eligibility
You must be 18 years or older to use the Service. By using it, you confirm that you are at least 18 and that the information you give us (including your quiz answers and email) is accurate and your own.
The Service is designed for runners in New Zealand and Australia. You're welcome to use it from anywhere, but our event database and the advice in our Race Packs are tailored for NZ and AU events.
2. The free quiz and your matches
The 9-question quiz is free to use. After you complete it, you'll see your top match. To unlock the rest of your matches, you'll need to give us your email address.
2.1 The quality of your matches
Your match results are based on:
- the answers you give us in the quiz; and
- the data we hold on each event in our database.
We do our best to keep our event database accurate, but we don't run the events ourselves. Race dates, distances, entry fees, terrain, mandatory gear, weather, and other details can change without notice. Always confirm the details directly with the event organiser before you enter or travel to a race.
The matching algorithm is a guide, not a guarantee. It can't account for everything — your injury history, your work commitments, the weather on the day, or the specifics of your training. Use your own judgement.
2.2 Your responsibilities
You're responsible for the accuracy of the information you give us. If you tell us you run 50km a week when you actually run 5km, we'll match you to races that aren't safe for you. Be honest with us, and you'll get useful matches.
3. The Race Pack
A Race Pack is a personalised, AI-generated race-preparation guide for a specific event. It includes (broadly): a budget estimate, a fueling plan, a kit checklist, a pacing strategy, a race-week timeline, a race-morning timeline, weather and terrain tips, mental-game tips, and common mistakes to avoid.
3.1 Price and payment
- A Race Pack costs NZ$35 (inclusive of GST where applicable). Prices may change — the price you see at checkout is the price you pay for that purchase.
- Payment is processed by Stripe. You agree to Stripe's terms when you pay.
- Once payment is confirmed, your Race Pack is generated and delivered to the email address you've given us.
- We may update prices, run promotions, or offer discounts at our discretion.
3.2 No refunds
The Race Pack is a digital product that is generated and delivered to you immediately on purchase. Once delivered, the purchase is non-refundable, except where:
- we're unable to deliver your Race Pack due to a technical failure on our end;
- the event you bought the Race Pack for is cancelled before the date and you contact us within 14 days of the cancellation; or
- you have rights under the NZ Consumer Guarantees Act 1993, the Australian Consumer Law, or another mandatory consumer-protection law that we cannot exclude.
To request a refund in any of the situations above, email hello@therunpact.com with your order ID and the reason for the request.
3.3 The Race Pack is AI-generated
Each Race Pack is generated by an AI model (Anthropic's Claude) using your quiz answers and our event data. AI models can make mistakes. We don't guarantee that every detail in your Race Pack is accurate, complete, or up to date.
You should:
- treat the Race Pack as general guidance, not as personal coaching, medical advice, or guaranteed instructions;
- double-check anything that matters — particularly mandatory gear, cut-offs, aid-station locations, and event-day logistics — with the official event organiser;
- use your own judgement and your own coach (if you have one) when applying the Race Pack's advice.

3.4 Health and fitness disclaimer
Read this carefully. The Race Pack provides general information about running, training, fueling, pacing, and race-day logistics. It is not medical advice, not a personalised training plan from a qualified coach, and not a substitute for advice from a doctor, physiotherapist, dietitian, or other health professional.
Running races — especially longer distances and trail events — involves a real risk of injury, illness, dehydration, exhaustion, hyponatraemia, falls, and in rare cases serious injury or death. Before you act on anything in your Race Pack, you should:
- consult a doctor before you start, increase, or change a training programme — particularly if you have any pre-existing condition (heart, respiratory, musculoskeletal, metabolic, or otherwise), are pregnant, are recovering from illness or surgery, or are taking medication;
- listen to your body — pain, dizziness, chest tightness, or unusual fatigue means stop and seek advice; and
- train within your current ability, not what the Race Pack assumes you'll be able to do by race day.
By using the Service and any Race Pack, you accept that you're entering and training for races at your own risk. To the fullest extent permitted by law, you waive any claim against us for any injury, illness, loss, or damage arising from your training for, travel to, or participation in any event — except where it's caused by our gross negligence or wilful misconduct, or where consumer-protection laws apply.
4. Intellectual property
4.1 Our IP
The Site, the quiz, the matching algorithm, the event database, the Race Pack template and prompts, the underlying code, the design, the RunPact name and logo, and all other content we provide are owned by Done By Nine Limited or our licensors, and are protected by copyright, trade-mark, and other intellectual-property laws.
4.2 Race Pack licence
When you buy a Race Pack, we grant you a personal, non-transferable, non-exclusive licence to use it for your own race preparation. This means you can:
- read it on any device you own;
- save it locally and print it for your own use; and
- refer to it as much as you like.
You may not:
- republish it on any website, blog, social media account, app, or marketplace;
- resell it, sublicense it, or transfer it to anyone else;
- share the full Race Pack publicly (sharing extracts privately with your coach, training partner, or family is fine);
- use it to train, fine-tune, or evaluate any AI or machine-learning model;
- remove or alter any branding or notices in the Race Pack; or
- use it for any commercial purpose.
4.3 Our own use
We retain the right to use, adapt, and reuse Race Pack templates, structures, prompts, and any of our underlying systems — including in future Race Packs for other users — without restriction.
4.4 Feedback
If you send us feedback, suggestions, or ideas about the Service, you grant us a worldwide, royalty-free, perpetual, irrevocable licence to use them however we like, without owing you anything.
5. Acceptable use
When you use the Service, you agree not to:
- use it if you're under 18;
- give us false or misleading information (including inaccurate quiz answers given for any purpose other than honestly seeking matches);
- use the Service for anyone else without their permission;
- attempt to access, scrape, copy, or reverse-engineer the Site, the matching algorithm, the event database, or our Race Pack systems;
- attempt to interfere with the operation of the Site (including via DDoS, malware, or unauthorised access attempts);
- use the Service in any way that breaches any law or regulation; or
- use the Service to compete with us or to build a competing product.
We may suspend or terminate your access to the Service at any time if we reasonably believe you've breached these Terms.
6. Third-party links and partner offers
The Site, your match results, and your Race Pack may include links to event organisers' websites, accommodation providers, gear retailers, and other third-party sites. We don't control those sites — we're not responsible for their content, their products, their pricing, their availability, or their privacy practices. Your dealings with any third party are between you and them.
We may also send you offers for events we've partnered with, sell entries to, or otherwise have a commercial relationship with. We'll always mark these clearly. You can opt out of marketing emails at any time (see our Privacy Policy).
6.1 Affiliate disclosure
In the future, the Service may include affiliate links — links to third-party events, services, or products where we earn a commission if you click through and purchase. At the moment, we do not earn affiliate commissions. When we start, we'll update these Terms and disclose this clearly on the Site and inside the relevant Race Pack.
We never let affiliate relationships influence whether an event makes your match list or where it ranks. Matching is based on the algorithm and your quiz answers — full stop.
7. Limitation of liability
This section limits our liability to you. Read it carefully.
7.1 The Service is provided "as is"
We provide the Service on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties, conditions, and guarantees not expressly set out in these Terms — including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We don't warrant that:
- the Service will be uninterrupted, error-free, or secure;
- the matches we generate will be accurate or right for you;
- the Race Pack will produce any particular result (including finishing or completing a race);
- event details on the Site will be accurate at any given time; or
- AI-generated content will be free of errors.
7.2 Our liability cap
To the fullest extent permitted by law, our total liability to you for any claim arising out of or in connection with the Service or these Terms — whether in contract, tort (including negligence), under statute, or otherwise — is capped at the greater of:
- NZ$100; or
- the total amount you've paid us in the 12 months immediately before the event giving rise to the claim.
We are not liable for any:
- indirect, incidental, special, consequential, or punitive loss;
- loss of profits, revenue, opportunity, or anticipated savings;
- loss of data;
- personal injury, illness, or death — except where caused by our gross negligence or wilful misconduct, or where liability cannot be excluded under consumer-protection law; or
- loss arising from your reliance on AI-generated content, third-party content, or event-organiser information.
7.3 Consumer-protection laws
Nothing in these Terms limits or excludes any rights you have under the NZ Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Australian Consumer Law, or any other law that we are not permitted to exclude. Where you acquire the Race Pack for a business purpose, you and we agree that the Consumer Guarantees Act 1993 does not apply.
8. Indemnity
You agree to indemnify and hold harmless Done By Nine Limited, its directors, employees, contractors, and service providers from and against any claim, loss, damage, cost (including reasonable legal costs) or liability arising out of:
- your breach of these Terms;
- your misuse of the Service;
- your participation in any race or training activity, regardless of whether you used a Race Pack to prepare; or
- any inaccurate or false information you've given us.
9. Privacy and data
How we collect and use your information is described in our Privacy Policy. By using the Service, you agree to that Privacy Policy.
10. Changes to the Service and these Terms
10.1 Changes to the Service
We're constantly improving RunPact. We may add, change, or remove features at any time. We may also stop offering the Service entirely on reasonable notice.
10.2 Changes to these Terms
We may update these Terms from time to time. When we do:
- we'll update the "Last updated" date at the top;
- for material changes, we'll email subscribers and post a notice on the Site at least 14 days before the changes take effect; and
- if you keep using the Service after the changes take effect, you accept the updated Terms.
If you don't agree to a change, your remedy is to stop using the Service. The version of these Terms in effect on the day you bought a Race Pack governs that purchase.
11. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you've breached these Terms or if we're required to by law.
You can stop using the Service at any time. You can also ask us to delete your account information by emailing hello@therunpact.com — see our Privacy Policy for details on data deletion.
Sections 3.4 (health disclaimer), 4 (intellectual property), 7 (limitation of liability), 8 (indemnity), 12 (governing law), and any other clause that by its nature should survive, will survive termination.
12. Governing law and disputes
These Terms are governed by New Zealand law. You and Done By Nine Limited submit to the non-exclusive jurisdiction of the New Zealand courts for any dispute arising out of or in connection with these Terms or the Service.
If you're a consumer in another jurisdiction (including Australia), you may have rights to bring proceedings in your local courts under your local consumer-protection laws — and we won't try to deprive you of them.

13. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. They replace any earlier discussions or representations.
- Severability. If any part of these Terms is found to be unenforceable, the rest of them stay in force.
- Waiver. If we don't enforce a right under these Terms, that doesn't mean we've waived it.
- Assignment. You can't assign or transfer your rights under these Terms. We can assign them to a successor (for example, if Done By Nine Limited is sold or restructured).
- No agency. Nothing in these Terms creates a partnership, agency, employment, or joint-venture relationship between you and us.
- Force majeure. We're not liable for any failure to perform caused by events outside our reasonable control — including natural disasters, pandemics, labour disputes, internet outages, and acts of government.
